Arizona HB2768

A Common-Sense Bill to Protect Small Businesses and Consumers

Arizona lawmakers are advancing HB 2768, a targeted reform that protects consumers’ wallets by stopping credit card networks from charging swipe fees on sales tax. In 2023, Arizona businesses paid over $217 million in swipe fees on sales taxes. As big banks profit, merchants and consumers are left to feel the squeeze.

Without reform, every purchase made in Arizona with a credit card will continue paying a hidden fee on local taxes that funnels Main Street earnings to Wall Street, forcing families and local communities to bear the cost.

What HB2768 Covers

Swipe Fees: Prohibits banks and payment networks (like Visa and Mastercard) from charging swipe fees on the tax portion of a transaction.
Taxes: Provides clarity on tax collection and payment for electronic transactions.
Penalties: Entities that violate these rules face civil penalties and must reimburse any interchange fees that were incorrectly charged.

Why It Matters for Arizona Businesses

As prices increase due to inflation, swipe fees rise automatically—without oversight, competition or negotiation. For Arizona businesses that already operate on thin margins, this means:

Increased prices to cover rising swipe fees, which act like a hidden tax.
Less flexibility to withstand economic downturns.
Fewer resources for wages, benefits and growth.

Why It Matters for Arizona Families

As prices increase due to inflation, swipe fees rise automatically—without oversight, competition or negotiation. For Arizona businesses that already operate on thin margins, this means:

Increased costs for everyday necessities.
Fewer affordable options as small businesses struggle.
More money leaving Arizona communities for out-of-state banks.

Keeping Arizona’s Economy Competitive

Arizona lawmakers can ensure this legislation works for the state’s economy, not just the financial industry. Consideration of swipe fees within HB2768 will:

Protect small businesses and local employers.
Encourage transparency and fairness in payments.
Reduce costs for families. Keep more consumer dollars circulating within Arizona.
